DIREITOS FUNDAMENTAIS “GOELA ABAIXO”: POLÍTICA AFIRMATIVA ÉTNICO-RACIAL E HETERONOMIA JUDICIAL

At the Federal University of Recôncavo da Bahia, a group of students benefiting from the actions affirmatives chooses not to use the access feature to the second training cycle, competing for widespread openings and allowing other students to also open up. Such a procedure heightens the tension on affirmative politics. The objective of this paper is to investigate whether the affirmative policy of reserving vacancies is a fundamental right that can be imposed on the black subject. The case study methodology of a judicial process in which this issue is faced will be used, along with readings on the historical process and the reason for such policies. In the end, they will be evaluated as consequences of the imposing application of the affirmative quotas policy for the proposed end of racial equality in access to higher education. It concludes by the contemporaneity of judicial conflicts that reinterpret the right to affirmative ethnic-racial policy as an imposing measure, slipping in no reverse effect of access and equality of racial justice desired by the action.Na Universidade Federal do Recôncavo da Bahia, um grupo de estudantes beneficiários da política de cotas raciais opta por não utilizar de tal recurso para acessar ao segundo ciclo formativo, concorrendo à s vagas de ampla concorrência e possibilitando que outros estudantes também negros acessem a política de reserva de vagas. Tal procedimento acirra a tensão sobre a política afirmativa. Objetiva-se com a presente pesquisa investigar se a política afirmativa de reserva de vagas é um direito fundamental que pode ser imposto ao sujeito negro. Será utilizada a metodologia de estudo de caso a partir de um processo judicial em que esta questão foi enfrentada, ao lado de leituras sobre o processo histórico e a razão de tais políticas. Ao final, serão avaliadas as consequências da aplicação impositiva da política afirmativa de cotas para o fim proposto da igualdade racial no acesso ao ensino superior. Conclui-se pela contemporaneidade de conflitos judiciais que reinterpretam o direito à política afirmativa étnico-racial como medida impositiva, resvalando em no efeito reverso de acesso e igualdade de justiça racial almejada pela ação
